For trans, intersex and gender-nonconforming Americans applying for or renewing passports, that change has caused anxiety and confusion.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Since June 2021, the <a class=\"css-yywogo\" href=\"https:\/\/travel.state.gov\/content\/travel\/en\/passports\/passport-help\/sex-marker.html\" title rel=\"noopener noreferrer\" target=\"_blank\">State Department<\/a> had allowed trans people to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/06\/30\/us\/politics\/gender-passports.html\" title>declare their gender<\/a> on U.S. passports without providing medical certification. With that suit pending, here\u2019s what we know about how the policy is affecting passport applications.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-5cd9b057\"><span><strong class=\"css-8qgvsz ebyp5n10\">Who exactly is affected by the order?<\/strong><\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">It applies to anyone whose gender identity differs from the sex they were assigned at birth.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">According to U.C.L.A.\u2019s Williams Institute, there are <a class=\"css-yywogo\" href=\"https:\/\/williamsinstitute.law.ucla.edu\/subpopulations\/transgender-people\/\" title rel=\"noopener noreferrer\" target=\"_blank\">about 1.6 million transgender people<\/a> in the United States. Though there\u2019s not a clear count of people who use X gender markers in America, there are <a class=\"css-yywogo\" href=\"https:\/\/dol.ny.gov\/news\/governor-hochul-announces-54-million-investment-lgbtq-community#\" title rel=\"noopener noreferrer\" target=\"_blank\">about 5,200 people<\/a> in New York State using the marker on IDs, and the California Department of Motor Vehicles recently <a class=\"css-yywogo\" href=\"https:\/\/www.kcra.com\/article\/california-dmv-trump-executive-order-gender-real-id\/63608792#\" title rel=\"noopener noreferrer\" target=\"_blank\">told the TV station KCRA<\/a> that there were 21,140 Californians using X markers on their state IDs.
