In all, five justices explored questions related to who may use which facilities, though bathrooms did not figure in the cases before them.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">\u201cLet\u2019s not avoid the difficult issue,\u201d said Justice Sonia Sotomayor, a member of the court\u2019s liberal wing, posing a hypothetical question: \u201cYou have a transgender person who rightly is identifying as a woman and wants to use the women\u2019s bathroom.\u201d<\/p>\n<div class=\"css-1dv1kvn\">\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">She added: \u201cThere are other women who are made uncomfortable, and not merely uncomfortable, but who would feel intruded upon if someone who still had male characteristics walked into their bathroom. Cole, a lawyer with the American Civil Liberties Union representing a transgender woman, seemed puzzled.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">\u201cThat is a question, Justice Sotomayor,\u201d he said. \u201cIt is not the question in this case.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">The argument also touched on sports, religion and dress codes, and it suggested that many justices found it hard to disentangle the legal question before them from related ones.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">Justice Neil M. Gorsuch, for instance, asked whether a ruling in favor of Mr. Cole\u2019s client would do away with sex-specific dress codes. Mr. Cole said no.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">\u201cThere are transgender male lawyers in this courtroom following the male dress code and going to the men\u2019s room,\u201d he said, \u201cand the court\u2019s dress code and sex-segregated restrooms have not fallen.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">When the court issued <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/17-1618_hfci.pdf\" title rel=\"noopener noreferrer\" target=\"_blank\">its decision<\/a>, which sided with gay and transgender workers, Justice Gorsuch\u2019s majority opinion said it was tightly focused on employment discrimination.<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">\u201cWe do not purport to address bathrooms, locker rooms or anything else of the kind,\u201d he wrote, adding that those \u201care questions for future cases, not these.\u201d<\/p>\n<p class=\"live-blog-post-content css-h61jh5 evys1bk0\">In dissent, Justice Samuel A.
